If you are a California resident, certain additional rights may apply to you under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), the California Consumers Legal Remedies Act (CLRA), and the California Unfair Competition Law (UCL).

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact Wing Snob at [email protected] and provide a written description of the dispute, the relief sought, and your contact information. The parties agree to negotiate in good faith to resolve the dispute informally for a period of at least thirty (30) days from the date of written notice before either party may initiate arbitration or litigation.

13.2 Binding Arbitration

If informal resolution fails, you and Wing Snob agree that any dispute, claim, or controversy arising out of or relating to these Terms, the breach or termination thereof, or the use of our services shall be resolved by final and binding arbitration, rather than in court, except that either party may seek injunctive or other equitable relief in court for the misappropriation or infringement of intellectual property rights.

Arbitration shall be administered by a recognized arbitration organization (such as the American Arbitration Association — AAA) in accordance with its Consumer Arbitration Rules in effect at the time of the dispute. The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Wing Snob shall not be liable for any failure or delay in performance of its obligations under these Terms arising out of or caused by events beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, governmental restrictions, war, terrorism, labor disputes, supply chain disruptions, power outages, internet service disruptions, or other circumstances beyond our reasonable control.

In such events, Wing Snob will use reasonable efforts to resume service as soon as practicable and will communicate with affected customers regarding anticipated delays or service disruptions.
